Judge overturns conviction of nephew in Making a Murderer

Judge overturns conviction of nephew in Making a Murderer

Judge overturns conviction of nephew in Making a Murderer: MADISON, Wis. — A judge on Friday overturned the conviction of a Wisconsin man found guilty of helping his uncle kill a woman in a case profiled in the Netflix series “Making a Murderer,” ruling that investigators coerced a confession using deceptive tactics.

U.S. Magistrate William Duffin in Milwaukee ordered Brendan Dassey freed within 90 days unless prosecutors decide to retry him. The state Department of Justice, which handled the case, declined to comment Friday. The state could also appeal Duffin’s ruling.

Dassey’s case burst into the public’s consciousness with the popularity of the “Making a Murderer” series that debuted in December. The filmmakers cast doubt on the legal process used to convict Dassey and his uncle Steven Avery in the death of Teresa Halbach, and their work sparked national interest and conjecture. Authorities involved in the case have called the 10-hour series biased, while the filmmakers have stood by their work.

Dassey confessed to helping Avery carry out the rape and killing of Halbach, but his attorneys argued that his constitutional rights were violated throughout the investigation. Dassey didn’t testify at his uncle’s trial and his confession wasn’t presented as evidence there. Both men are serving life sentences.
Duffin said in his ruling that investigators made false promises to Dassey by assuring him “he had nothing to worry about.”

“These repeated false promises, when considered in conjunction with all relevant factors, most especially Dassey’s age, intellectual deficits, and the absence of a supportive adult, rendered Dassey’s confession involuntary under the Fifth and Fourteenth Amendments (of the U.S. Constitution),” Duffin wrote.

Dassey, who is now 26, was 16 when Halbach, a photographer, was killed in 2005 after she went to the Avery family auto salvage yard to take pictures of some vehicles. Court papers describe Dassey as a slow learner with poor grades, with difficulty understanding some aspects of language and expressing himself verbally. He was also described as extremely introverted and poor at picking up on communications such as body language and tone.

Dassey was convicted of first-degree intentional homicide, second-degree sexual assault, and mutilation of a corpse in Halbach’s killing. Avery was tried and convicted separately in the homicide.

Avery made headlines in 2003 when he was released from prison after spending 18 years behind bars for a rape he didn’t commit. After being freed, he had a $36 million lawsuit pending against public officials when Halbach disappeared on Halloween 2005.

Friday’s ruling came after Dassey’s appeal was rejected by state courts. The judge said that Dassey’s confession to police in 2006 was “so clearly involuntary” that a state appeals court ruling to the contrary was an unreasonable application of established federal law.

“The court does not reach this conclusion lightly,” Duffin wrote.

The investigators did not have any ill motive, the judge wrote, but rather “an intentional and concerted effort to trick Dassey into confessing.”

The error was not harmless because Dassey’s confession was the entirety of the case against him, the judge said.

Laura Nirider, one of Dassey’s attorneys, said he thought that if he told investigators what they wanted to hear, he’d get to go back to school.

“This is justice for that 16-year-old kid ... who we all saw being bullied into giving a statement that was completely untrue,” she said.

Dassey, who has been incarcerated for 10 years, is in shock and wants to go home, she said. If prosecutors decide to bring a new trial, the confession would not be usable, she said.

A brother who has acted as a Halbach family spokesman did not immediately respond to phone messages and an email.

Kathleen Zellner, an attorney for Avery, said in a statement that Avery was thrilled for his nephew. Avery is pursuing his own appeal.

“We know when an unbiased court reviews all of the new evidence we have, Steven will have his conviction overturned as well,” Zellner said.

Joe Friedberg, a defense attorney in Minnesota who was not involved in the case but is familiar with it and participated in a forum on it with Avery’s first defense attorney, said he doesn’t believe the decision will have any bearing on Avery’s case.

“The kid’s confession was not entered into evidence against Avery, and I don’t think it impacted Avery’s trial at all,” Friedberg said.

Netflix last month announced that new episodes of “Making a Murderer” were in production to follow appeals by both Avery and Dassey.

“As we have done for the past 10 years, we will continue to document the story as it unfolds, and follow it wherever it may lead,” filmmakers Laura Ricciardi and Moira Demos said in a written statement following Friday’s ruling.

Turkey issues arrest warrant for ex-soccer star

Turkey issues arrest warrant for ex-soccer star

Turkey issues arrest warrant for ex-soccer star :ANKARA, Turkey,Turkish authorities have issued a warrant for the arrest of former soccer star and legislator Hakan Sukur over his links to a U.S.-based Muslim cleric, accused by Turkey of masterminding last month's failed coup, media reports said Friday.

Meanwhile, Turkey's foreign minister told reporters that 32 Turkish diplomats who were called back to Turkey as part of an investigation into the coup attempt had failed to return.

Turkey has launched a massive crackdown on alleged supporters of the movement led by Fethullah Gulen, in the aftermath of the July 15 coup attempt that left more than 270 people dead, raising concerns among European nations and human rights groups.

More than 35,000 people have been detained for questioning while tens of thousands of others from government jobs, including in the judiciary, media, education, health care, military and local government. Gulen, who runs a network of worldwide charities and schools from self-imposed exile in Pennsylvania, has denied any knowledge or involvement in the coup.

The state-run Anadolu Agency said an arrest warrant was issued for Sukur late Thursday, accusing him of "membership in an armed terror organization." Prosecutors had also demanded the arrest of Sukur's father, the report said. A court has also ordered that both men's assets in Turkey be seized, Anadolu said.

Sukur, who reportedly left Turkey last year, played for Inter Milan and Galatasaray and was Turkey's top goal-scorer in international competition. He has made no secret of his affiliation to Gulen, and resigned from the ruling party in 2013 following a government rift with the movement.

During a joint news conference with his Iranian counterpart, Foreign Minister Mevlut Cavusoglu said that of the 208 diplomatic personnel serving in foreign posts recalled following the coup, 32 had not complied and had fled to other countries.

Cavusoglu added that the ministry was in touch with the countries to which they had fled, seeking to secure their return.

Turkey has branded Gulen's movement a terror organization and wants the cleric returned to Turkey to face trial. Washington has said it would need evidence of the cleric's involvement, and says the regular extradition process must be allowed to take its course.

During Friday's press conference, Cavusoglu said that a delegation from the U.S. Department of Justice would be arriving on Aug. 22 and meet with their Turkish counterparts on the following two days to discuss the extradition request.

Justice Minister Bekir Bozdag said the U.S. delegation would include three Justice Department experts and one from the State Department.

Entourage's Jerry Ferrara Is Engaged to Breanne Racano

Entourage's Jerry Ferrara Is Engaged to Breanne Racano: He may have been unlucky in love on Entourage, but Jerry Ferrara has found his happily ever after in real life. The actor announced his engagement to girlfriend Breanne Racano in a sweet Instagram post on Thursday, August 11.

I SAID YES!!! Wait I mean… I've had many great blessings in my life. But this one by far is the best of all time," he captioned a cute pic with his new fiancée and her sparkling engagement ring. "You are the greatest person I ever met!"

Racano, 30, an actress who appeared in Entourage in 2011 and had an uncredited role in the big-screen adaptation last year, shared the same picture on Instagram, writing, "I am so lucky to marry this man.

The pair have been dating since 2014 and collaborate on the podcast Bad 4 Business with Jerry Ferrara. They celebrated their 100th podcast with a celebratory installment titled "Bad 4 Engagements" posted in the early hours of Friday, August 12.

"Is it bad for business to go on your podcast and talk about the fact that you just got engaged?" Ferrara, 36, asked guest psychotherapist Sarah Michael Novia.

"Yay! I'm getting married!" Racano chimed in.

He admitted that he accidentally let the cat out of the bag about their engagement during an interview on The Vertical Podcast with JJ Redick.

The Power star also revealed that he had been planning to pop the question since last year and asked Racano's dad and mom for their daughter's hand in marriage, saying, "I guess I am traditional in that sense."

He proposed on July 31, a few days after he'd originally hoped to get down on one knee when his original plan was spoiled by a spat over a competitive game night at a friend's house.

Ferrara split from Jamie-Lynn Sigler in 2009, and dated Katie Cassidy in 2012.

Rugby: Fiji wins first Olympic gold medal with win over Great Britain

Rugby: Fiji wins first Olympic gold medal with win over Great Britain

Rugby: Fiji wins first Olympic gold medal with win over Great Britain: Rio de Janeiro (CNN)As the final whistle sounded Fiji's rugby sevens captain Osea Kolinisau sank to his knees, struggling to take in what he and his team had achieved.

The Pacific island nation's long wait for an Olympic medal was over. And when it finally arrived, it was a gold in a sport embraced with near-religious fervor among its 900,000 people.

Billed as heavy favorites ahead of the tournament, Fiji delivered with an emphatic, bruising 43-7 defeat of Great Britain.

"I was just thankful to the lord for blessing us and giving us an opportunity to win in a mega-sport arena like the Olympics," Kolinisau told a press conference that began with the sound of applause.

"I never dreamed of being an Olympian, let alone being a medalist, let alone being a gold medalist. So I was just thankful to up above for the journey God has brought me on."

This landmark triumph arrived at Fiji's 14th Summer Games and in sevens' first appearance in the Olympic program. The raucous atmosphere at a packed-out Deodoro Stadium suggested the country and the sport had been well received by the locals.

And in a bid to further endear themselves to one particular distinguished guest, Fiji's players knelt when handed their medals by Britain's Princess Anne.

Among the many Fiji fans in the crowd, many of whom had adopted the team over the course of the day, was Etu Baravilala.

The 48-year-old stood on the front row throughout Fiji's golden day, beating his bare chest and bellowing at the top of his lungs.

He could scarcely be any further from his day job as a prison guard in Hawaii. Baravilala has lived in the US for 30 years but his heart still belongs to Fiji, the land of his birth.

Bedecked in traditional warrior dress, Baravilala sought to infuse his countrymen on the field with "mana" -- a term which refers to granting people or objects supernatural power or strength. It seems his efforts paid off.

Asked what this win would mean to the people of Fiji, he had a simple demand.

"We want a day off!" he told CNN. "That'd be good!"

In an ironic twist, Fiji's victory was masterminded by a Brit. Ben Ryan has coached the team for three years and is credited with instilling discipline into his team's outrageously talented players.

"I feel very lucky that I'm in charge of such an unbelievable group of athletes with a country behind us that is so passionate about rugby sevens," said Ryan.

"I try to explain it to people who don't go to Fiji or who have never been and it's impossible really," Ryan added on his adopted nation's love for sevens.

"The boys are front page and back of newspapers, six o'clock news... You come out of the airport and there's a 20-foot billboard of them. They're superstars in Fiji.

"I can have an hour-long drive to work and I can see 50 villages playing rugby. It's a passion. It's the national sport. They won't be having parties in sporadic parts of the country, it will be across the entire nation."

The celebrations come at a time when many in Fiji are still struggling after the devastating effects of Cyclone Winstone, which killed more than 40 people and left more homeless in February this year.

A first Olympic medal, especially in rugby, will doubtless be a welcome distraction.

"Rugby is like a religion in Fiji, and we're already a very religious country," deputy editor-in-chief of the Fiji Times, Elenoa Baselaia, told CNN.

"It's normal that we go to church on Sundays, it's also normal that everywhere you turn, there is people playing rugby every afternoon.

"Whether it's with paper scrunched together to make a ball, it's with bottles or a real rugby ball, somebody in the neighborhoods is playing rugby."

Simone Manuel Makes History in the Pool

Simone Manuel Makes History in the Pool

Simone Manuel Makes History in the Pool:RIO DE JANEIRO — Katie Ledecky’s roommate at the Olympics is setting records now, too.

Simone Manuel, who is sharing a room with Ledecky in the athletes’ village here, became the first African-American woman to win an individual event in Olympic swimming on Thursday night. She and Penny Oleksiak of Canada tied for the fastest time, an Olympic record in the women’s 100-meter freestyle: 52.70 seconds.

“I definitely think it raises some awareness and will get them inspired,” Manuel, 20, said about the significance of her accomplishment. “I mean, the gold medal wasn’t just for me. It was for people that came before me and inspired me to stay in the sport. For people who believe that they can’t do it, I hope I’m an inspiration to others to get out there and try swimming. You might be pretty good at it.”

Manuel and Oleksiak shaved 0.01 seconds off the Olympic standard of 52.71, set earlier in the Rio Games meet by Australia’s Cate Campbell. Sweden’s Sarah Sjostrom won the bronze in 52.99.

The last time an American won gold in the event was 1984, when Nancy Hogshead and Carrie Steinseifer also tied and shared the gold medal with a time of 55.92 seconds.

Several black swimmers have won Olympic medals for the United States. The first female of African-American descent to make an American Olympic team was Maritza Correia, a member of the 400-meter freestyle relay team that won silver at the 2004 Athens Games.

Lia Neal, a Brooklyn native, won a bronze in a relay at the 2012 London Games and a silver in a relay here at the Rio Games.

Anthony Ervin and Cullen Jones, who are black, have won Olympic gold medals.

Both Manuel and Oleksiak had to come from behind to take the victory on Thursday night. Manuel was third at the halfway mark, while Oleksiak was seventh at the turn.

At the finish, Manuel looked at the scoreboard and seemed surprised and thrilled, covering her mouth with her hand.

“I was pretty shocked,” said Manuel, who is from Sugar Land, Tex., and attends Stanford. “My goal coming in was to get on the medal stand after seeing how I swam in prelims and semifinals. But getting a gold medal in my first Olympics, I still can’t describe it but I’m really excited about it.”

Simone Biles’s Coronation is Complete

In case anybody had doubts, Simone Biles made it official: she’s the best gymnast in the world. The American dominated the women’s all-around competition on her way to a gold medal Thursday. In doing so, she joined Mary Lou Retton, Carly Patterson, Nastia Liukin and Gabby Douglas as American all-around winners. Aly Raisman (U.S.) won the silver, and Aliya Mustafina (Russia) won bronze

Phelps Wins a Record 13th Individual Gold

Michael Phelps won the 200 individual medley easily, beating not only teammate Ryan Lochte, but an ancient Greek.

Leonidas of Rhodes won 12 individual events over four Olympics. At 36, five years older than Phelps, he won his last three golds in 152 B.C, in races of about 200 and 400 meters and in a shield-carrying race. It wasn’t easy, but Phelps surpassed Leonidas, winning his 13th individual gold (and 22nd gold overall and 26th medal). With the victory, Phelps also joined the track and field Olympians Al Oerter and Carl Lewis as the only Americans to win an individual event four times.

Phelps was timed in 1 minute 54.66. He won by over a bodylength, and the time was his second-best ever behind a 1:54.23 from Beijing. He held up four fingers afterward to indicate his four consecutive victories in the event. Japan’s Kosuke Hagino took the silver. Lochte finished fifth.
